The SIMPLE Steps to Removing Medical Collections From Credit Reports

We've all received unexpected bills from a hospital or a clinic and wondered why insurance didn't cover it, right? 

And sometimes these bills can be HUGE, and most normal people like you and me have a hard time paying them.

Unfortunately, this isn't a debt that just goes away if you don't pay it... 

No, medical providers will SELL THE DEBT to collection agencies. And they’ll do it for pennies on the dollar. Then the collectors add interest, and they harass you for the full payment and often double or even triple report the same account to the credit bureaus! 😤😤😤

It's a TERRIBLE system, and it hurts a lot of people…

According to the Department of Health and Human Services, if debt to a medical facility goes unpaid, they have the right to take measures to collect the debt, including…selling your personal information to a debt collector!

BUT, here’s the good news

The information that can be provided to the debt collector is very, very limited. They can only share your:

  • Name
  • Address
  • Social Security
  • Date of Birth 
  • Payment History
  • The location/name of the facility where you were treated

That's it!

They absolutely CANNOT share the nature of your treatment or the details of procedures with your debt collector. This includes:

  • Paperwork or bills that disclose medications you've taken
  • Ailments or diseases you may have been diagnosed with or treated for

Now, how does this help you remove medical debt from credit reports? 

If a collection agency provides you with ANY of these private details, they are in direct violation of HIPAA regulations, and they face SEVERE fines

See, the main purpose of HIPAA is to prevent ANYONE from abusing our personal health information. And HIPAA regulations affect collection agencies if they’re dealing with medical debt.

In fact, collection agencies must sign a HIPAA Business Associate Agreement to indicate that they will comply with HIPAA regulations involving protected health information. 

In order to collect a medical debt, collection agencies do not need ANY of that detailed information about your health and medical history!

Collection agencies are also responsible for making sure that any protected health information that they receive is secured from unauthorized access. 

So, how do you use HIPAA to delete medical collections?

It's easy! 

Important Tip: Remember, you should always grab the low-hanging fruit first and dispute the collections with the credit bureaus. Sometimes that is all you need for easy deletion. If you’ve already tried that, the next step in the Basic Disputing process - covered in CRC’s Basic Disputing Course - is to demand validation. You can use the validation letters available in your Credit Repair Cloud library and wait for the response. 

If the debt collection agency responds with too much of your client's personal information or ANY details of medical procedures performed, then it's time to put them on notice!

How do you do that? 

You use the Validation of Medical Debt letter - the HIPAA request letter included in your Credit Repair Cloud. 

This is a powerful letter, and it works very well to scare the bejeezus out of the debt collectors because you are essentially threatening them with a lawsuit for HIPAA violations. 

And you can usually convince collection agencies to delete the account if they have violated HIPAA laws! This is a great tactic that often results in immediate deletion. But at the very least, even if they don't delete the collection from your client's credit report, you will likely be able to use the violations as a strong negotiating point to go after a paper deletion deal. 

So, that's it! All it takes are the right letters and tactics. 

You can take the power away from the collection agencies and put it back into the hands of the people that they're trying to hurt.
